These Terms and Conditions ("Terms") govern your use of the Vignettes mobile application (the "Application") operated by Certo Partners (the "Service Provider"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.
Vignettes is a home-staging inventory management application that allows users to catalog, photograph, organize, and track physical inventory items used in home-staging projects.
To use the Application you must create an account using a valid mobile phone number capable of receiving SMS text messages. You are responsible for maintaining the confidentiality of your device and for all activity that occurs under your account.
Program name: Vignettes Login Verification.
Program description: The Service Provider sends one-time passcodes (OTPs) via SMS text message to verify your identity when you log in to the Application. No marketing, promotional, or informational messages are sent through this program.
How to opt in: You opt in by entering your mobile phone number on the Application's login screen and tapping "Send code", which you do each time you wish to authenticate. By doing so, you expressly consent to receive a one-time SMS verification code from Vignettes at the number you provided.
Message frequency: Message frequency varies and depends on your login activity. You will typically receive one (1) SMS message per login attempt.
Message and data rates: Message and data rates may apply. Check with your mobile carrier for details about your plan.
Supported carriers: The program is available on most major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages.
How to opt out: Reply STOP to any message to unsubscribe. After you send STOP, you will receive a confirmation message and no further SMS messages will be sent. Because SMS is used for login verification, opting out will prevent you from logging in to the Application until you opt back in. To opt back in, enter your phone number on the login screen again.

Certain features of the Application may require a paid subscription. Subscription fees are billed in advance on a recurring basis through the payment processor disclosed at checkout. You may cancel your subscription at any time through the Application or by contacting the Service Provider; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
You agree not to (a) use the Application for any unlawful purpose; (b) attempt to gain unauthorized access to the Application, its servers, or other users' accounts; (c) reverse-engineer, decompile, or disassemble the Application; (d) upload content you do not have the right to upload; or (e) interfere with or disrupt the Application's operation.
You retain ownership of photos, inventory records, and other content you upload ("User Content"). By uploading User Content, you grant the Service Provider a limited, non-exclusive license to store, process, and display that content solely to operate the Application for you. The Service Provider does not claim ownership of your User Content and will not use it for marketing without your explicit consent.
The Application, including its source code, design, trademarks, and branding, is the property of the Service Provider and is protected by copyright and other intellectual-property laws. These Terms do not grant you any right to use the Service Provider's trademarks or branding.
The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Application.
The Service Provider may suspend or terminate your access to the Application at any time for violation of these Terms. You may stop using the Application at any time by uninstalling it from your device.
The Service Provider may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Application after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which the Service Provider is organized, without regard to conflict-of-law principles.
Your use of the Application is also governed by our Privacy Policy, which describes how we collect and use your information.
